Article 1 : Scope
These general terms and conditions of sale exclusively govern the current and future business relationship between DMR Ergonomics (“us”) and the originator of the order (“you”).
The purpose of the present general terms of sale is to define the rights and obligations of the purchaser concerning the products sold within the standivarius.com online shop. In the event of an actual purchase order, the contract is governed by mail order sales regulations and the laws of Romania.
The product offers and prices featured on the standivarius.com site are valid for as long as they appear on the site and are subject to product availability.
The present general terms of sale can be modified at any time provided said modifications appear on the site standivarius.com .
Article 2 : Products
DMR Ergonomics is not responsible for any accident or damage that might occur due to use of the products sold.
The products offered in the standivarius.com shop are covered by the legal warranty against hidden defects provided according to the Warranty Terms.
Article 3 : Order
We agree to accept your purchase order according to the present general terms and conditions of sale.
Please note however that your order will be filled according to product availability.
During the ordering process, we will inform you about to the availability of the products you wish to purchase. However, and despite the care taken to avoid such a situation, should the products be temporarily unavailable (inventory shortage, reprinting, etc.) following your order, we will inform you about the situation by e-mail and invite you to cancel or modify your order. Should the products be permanently unavailable (stock depletion, etc.) following your order, we will automatically cancel the order and inform you of the situation by e-mail.
By confirming your order, you expressly declare you accept, acknowledge and agree to the present general terms and conditions of sale as they appear on the site and correspondingly agree to refrain from producing any conflicting documents, particularly your own general terms of purchase; your purchase being considered as an acceptance of these general terms of sale. This confirmation as well as any information we will have recorded will constitute evidence of our transactions.
Article 4 : Prices and invoicing
In accordance with Romanian Laws, the prices are indicated VAT included (24%). The customer has the option to choose among the 3 currencies – EUR, USD or GBP – to finalize the purchase ; Delivery charges are expressed separately. We reserve the right to modify our prices at any time, although we apply the rates in effect at the time of your order.
Customs duties specific to certain countries are exclusively at the customer’s expense (outside of the European Union).
Article 5 : Payment
Payment is immediately due on the date the order is placed. Payment methods available are displayed according to the country of delivery.
The data concerning your bank card is never recorded by us, but exclusively by payment operators (such as Moneybookers, PayPal etc) that guarantee secured payments. All the information regarding payments are transmitted from your computer to the payment processor through a highly secured channel. Therefore, DMR Ergonomics never has direct access to this data.
However, for security reasons, all IP addresses of the clients having placed an order on our website are recorded in our database.
Article 6 : Delivery and delivery charges
Unless otherwise provided, delivery is made to the address given at the time you placed the order. Risk will be at your expense from the date on which the ordered products leave our premises. Delivery estimation are for information purposes only and are not contractual by any means.
Deliveries are made to all countries listed in the checkout process. The orders are shipped from DMR Ergonomics premises by the Romanian Post.
Shipping and handling fees are calculated according to the weight and the destination of the order.
Delivery are expected to take 7 to 10 days to Europe, and 15 to 31 days to the rest of the world. The aforementioned is an average deadline that will vary according to the destination. Delivery deadlines are for information purpose only. Overrunning this deadline will not give any right to any order cancellation, to any reduction in the price paid by the buyer or to any payment of damage compensation provided DMR Ergonomics makes immediate contact and damage was unintentional and did not occur as a result of gross negligence.
Article 7 : Right of withdrawal
The consumer has 30 business days from the delivery date of his/her order within which he/she may return any non satisfactory item and request an exchange or reimbursement of the original product price. Forwarding charges and return carriage fees or other addition fees such as custom duty remain at purchaser’s expense.
Beyond this 30 day deadline, the ordered products will be deemed to comply with your order and consequently accepted by you.

Article 8 : Retention of title
The delivered goods will remain our property until all of your obligations have been met, particularly until full payment has been made. This retention of title does not interfere with the transfer of risks at your expense from the date on which the ordered products leave our premises, in compliance with the provisions of Article 6.
Article 9 : Products Warranty
Sold goods are shipped at purchaser’s own risk. It is highly recommended you check package integrity and transmit any reservations to the shipper or refuse the goods when in doubt.
If not stated otherwise, every STANDIVARIUS product purchased through standivarius.com shop are covered 1 year warranty.

Article 10 : Personal data protection
Personal data protection is of a high concern for us, therefore we are committed to pursue any possible and legal way to keep the information confidential. We collect different kinds of information on our website, and we try to limit this information to what is relevant and necessary to conduct smooth and safe transactions.
We do not share personal information with any of our partners, except the payment processors who might require information from us. On the other hand, payment processors do not share personal payment information with us, just as stated in article 5 (Payment).
The only personal information we exchange with other parties such as authorities is done under strict legal framework and with the exclusive purpose of protecting again fraud.

Article 11 : Intellectual property
All online store photos, pictures, logos, graphic designs, illustrations, comments and texts are protected by international copyright laws.
On these grounds and in compliance with the provisions of the Intellectual Property Code, only private representations free of charge and within the home as well as copies or reproductions strictly reserved for private use and not intended for collective use are authorized. Failing the prior written authorization of DMR Ergonomics, any other use constitutes infringement and is punishable according to the Intellectual Property Code.
Article 12 : Applicable law and court of competent jurisdiction
The present general terms and conditions of sale are governed by Romanian laws. Any disputes regarding the business relationship that exists between you and us will fall within the sole jurisdiction of the Romanian courts.
